1. Introduction 

These Terms and Conditions ("Agreement") govern the purchase and use of the Power BI App ("the App") provided by FreshBI ("the Company"). By purchasing and using the App, you ("the User" or "Customer") agree to comply with and be bound by the following terms. 

2. License Grant 

Upon purchase, the Company grants the User a non-exclusive, non-transferable, limited license to use the App for personal or business use. This license is subject to compliance with these Terms and Conditions. 

3. Payment Terms 

3.1. The User agrees to pay the fee specified at the time of purchase. 
3.2. Payments are non-refundable, except as expressly stated in this Agreement. 
3.3. The Company reserves the right to change the price of the App at any time, provided that the new price will not apply retroactively to previously purchased licenses. 

4. App Usage 

4.1. The App is provided for informational and analytical purposes. The Company makes no warranties about the accuracy or completeness of the data processed by the App. 
4.2. The User is responsible for ensuring their Microsoft Power BI account is active and meets the necessary requirements to operate the App. 

5. Intellectual Property 

All intellectual property rights in the App, including software code, design, and documentation, remain the property of the Company. The User may not modify, distribute, or create derivative works based on the App without the prior written consent of the Company. 

6. Data Privacy 

The Company respects your privacy. Any personal or business data collected during the operation of the App is governed by the Company's Privacy Policy. The Company will not share or sell any User data to third parties without explicit consent unless required by law. 

7. Updates and Maintenance 

The Company may provide updates, bug fixes, and new features for the App from time to time. The User is responsible for installing updates as necessary to maintain compatibility with Power BI and other dependent services. 

8. Limitation of Liability 

The Company will not be liable for any direct, indirect, incidental, or consequential damages arising from the use or inability to use the App, including but not limited to data loss, loss of profits, or system failures. 

9. Termination 

The Company reserves the right to terminate the User’s access to the App at any time, without notice, for any breach of these Terms and Conditions. 

10. Governing Law 

This Agreement shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles. 

11. Amendments 

The Company reserves the right to modify these Terms and Conditions at any time. Users will be notified of any significant changes, and continued use of the App after such modifications will constitute acceptance of the new terms.
