# Mission Control Terms and Conditions of Service

## 1. Acceptance of Terms

By accessing or using the Mission Control platform (“Service”), you (“User” or “Publisher”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use the Service.

## 2. Service Description

Mission Control provides a technology platform exclusively for video game publishers, offering real-time digital asset management, data insights, and performance marketing tools to optimize content publishing, monitor sales, and manage digital marketing assets. The Service supports all major gaming platforms and enables data-driven decision-making.

## 3. Eligibility

The Service is intended for legal entities engaged in video game publishing. Use by individuals or entities not involved in game publishing is prohibited.

## 4. User Responsibilities

* Provide accurate and complete information during registration and use.
* Ensure compliance with all applicable laws and regulations related to your use of the Service and digital content.
* Maintain the confidentiality of access credentials and prevent unauthorized use.
* Use the Service solely for lawful publishing and asset management purposes.

## 5. Data and Content

* Users retain ownership of their data and digital assets uploaded to the platform.
* Mission Control processes and stores User data securely, employing industry-standard encryption and access controls.
* Users grant Mission Control a non-exclusive license to use necessary data for providing the Service and improving its features.
* Users are responsible for ensuring rights and permissions for all uploaded content.

## 6. Confidentiality

* Each party agrees to maintain the confidentiality of all non-public information disclosed by the other party in connection with the Service.
* Confidential information shall only be used to perform obligations under these Terms and shall not be disclosed to any third party without prior written consent, except as required by law.
* This obligation survives termination of the agreement.

## 7. Access and Use Restrictions

* Users must not interfere with or disrupt the integrity or performance of the Service.
* Unauthorized attempts to access or tamper with the Service or other Users’ data are prohibited.
* Users may not use the Service to engage in grey market activities, fraudulent behavior, or infringe third-party rights.

## 8. Intellectual Property

* All intellectual property rights in the Mission Control platform and services belong to the service provider or its licensors.
* Users may not copy, modify, distribute, or create derivative works from the Service except as expressly permitted.

## 9. Data Processing

* Mission Control acts as a data processor for User data and will comply with applicable data protection laws, including the GDPR.
* Mission Control will process data only on documented instructions from the User.
* Mission Control implements appropriate technical and organizational measures to protect personal data against unauthorized or unlawful processing, accidental loss, destruction, or damage.
* Users must ensure that they have all necessary rights and consents to upload and share data through the Service.
* Data transfers outside the European Economic Area (EEA), if any, will be subject to adequate safeguards as required by law.

## 10. Service Availability and Updates

* Mission Control will strive to provide uninterrupted access but does not guarantee continuous, error-free operation.
* The Service may be updated, modified, or discontinued at any time with or without notice.

## 11. Limitation of Liability

* The Service is provided “as is” without warranties of any kind.
* Mission Control shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of the Service.
* Users assume all risks associated with use of the Service and data accuracy.

## 12. Indemnification

Users agree to indemnify and hold harmless Mission Control and its affiliates from any claims, damages, or losses arising from User’s breach of these Terms or misuse of the Service.

## 13. Termination

Mission Control may suspend or terminate access to the Service for Users who violate these Terms or engage in harmful activities.

## 14. Dispute Resolution and Governing Law

* Any disputes arising out of or in connection with these Terms shall first be attempted to resolve amicably through negotiation between the parties.
* If unresolved, disputes shall be submitted exclusively to the competent courts of the Netherlands.
* These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law rules.

## 15. Changes to Terms

Mission Control may update these Terms at any time. Continued use of the Service after changes constitutes acceptance.
