Please read these terms and conditions carefully before using our service

1 . INTRODUCTION

Our services have been shared with you by and/or embedded into the website or mobile application of a Third Party, as below identified, for your benefit.
These terms (the “Terms”) explain the rules for using our Services as defined below, which are provided directly by us or through the Third Party’s website, mobile application or other electronic means
These Terms are limited to your use of the Services. They are in addition to the terms that govern your use of the Third Party’s products and/or services.
We are Prestatech GmbH, a limited liability company registered in Germany, registration number 174193, commercial register B of the court of Berlin Charlottenburg, and have our registered office at Saarbrücker Str. 3610405 Berlin, Germany.
In these Terms, references to “Prestatech”, “we” or “us” or similar is a reference to Prestatech GmbH.
By accessing or using the Services in any way and through any means, you are agreeing to be bound by these Terms together and you confirm the acknowledgment of our Privacy Policy available at the link below which sets out how we process personal data we collect from you with reference to the Services. If you do not agree to these Terms and/or if you haven’t acknowledged our Privacy Policy, you must not use our Services.
These Terms also contain provisions about what we will and will not accept liability for if you suffer loss or damage in connection with use of the Services. When you enter into these Terms, you agree and confirm:
you are over 18 years old.
all the information you have provided to us and/or the Third Party is accurate and correct.
that you are the person whose details you have provided, or, in the case where the details provided pertain to another person, that you have obtained their consent and/or have the authority to provide also such details on their behalf.
you can enter into a legally binding agreement with us.
you will only use the Services as envisaged by these Terms; and.
where any intellectual property rights belonging to you are contained in the Financial Information (see below), you grant us a non-exclusive, sublicensable, royalty free licence to use them to perform our obligations under these Terms.
We can make changes to these Terms and/or to the way we operate the Services from time to time and will take reasonable steps to bring any material changes to your attention via our website. Each time you wish to use the Services, please check the Terms to ensure you understand them. If, for any reason, you have any issues accessing any of our Terms, please submit your request to support@prestatech.com.
Our Services are intended for users residing in the European Union and may not be appropriate for use or available in other locations.
2 . SERVICES
We provide (the “Service” or the “Services) data collection, data digitalization and cash-flow based analysis to our clients (our “Clients” or “Third Parties”) who, in turn, use our expertise to create innovative products or services that are made available to you. Our Services rely and are based on information directly provided by you or other parties you authorized. Such information is constituted by some or all of your account information, balances and transactional information (together, “Financial Information”). When you use the Service, you authorize us to process your Financial Information in accordance with the Third Party’s requirements. The Third Party may or may not choose to make some or all of it available for you to view.
Services are provided on an ‘as is’ basis and we make no warranty or representation as to the accuracy of the information generated by our tools, nor the functionality of the Services. We do not check the accuracy of the Financial Information before it is provided to the Third Party, nor are we responsible for any decision made in relation to the Financial Information.
Once your data, including your Financial Information, is transmitted through our Services to the Third Party, the Third Party shall be solely responsible for its handling, processing, and storage. You should read the rules on data protection and privacy of such the Third Party, as well as our Privacy Policy. Any product or service offered by a Third Party to you will be governed by the terms between you and that Third Party. We have no responsibility for such products and services and are not liable to you for any harm, damage or loss arising from your use of those products and services.
We or the Third Party may require you to re-authenticate or provide your updated Financial Information from time to time. Without doing so, we and the Third Party might be unable to provide the products and services.
3 . RESTRICTIONS ON THE USE OF SERVICES
End-users must adhere to the following restrictions regarding the use of our Services:
Not engaging in any illegal or fraudulent activities using the Services.
Not attempting to breach or compromise the security of our information systems.
Not sharing sensitive information about others without their express consent.
Abiding by all applicable copyright and intellectual property laws.
Refraining from decompiling, reverse engineering, or otherwise attempting to extract the source code of the software underlying the Services.
Avoiding any use of the Services that could potentially damage the Company or its reputation.
Failure to comply with these restrictions may result in immediate termination of access to the Services and potential legal action.
4 . MODIFICHE CHANGES
We will give you up to one month prior written notice of any intended material changes to these Terms along with the new version of the Terms via our website in case such change directly affects you. If you do not agree with the proposed changes you must not use our Services. If you continue to use our Services, you will be deemed to have accepted the changes to the Terms.
5 . FEES
No fees are payable by you to us for your use of the Services as an end-user.
6 . INTELLECTUAL PROPERTY
Prestatech is the owner or the licensee of all intellectual property rights in the Services and all rights are reserved.
Prestatech is our trademark. You will not make any unauthorized use of this trademark. Any unauthorized use may result in legal action being taken against you.
Your use of the Services does not transfer any rights to the content and related intellectual property rights contained in the Services.
Users are not permitted to share, reproduce, or distribute any content from our services without explicit written consent from us. This restriction includes educational and personal use.
7 . OUR LIABILITY TO YOU
In addition to any other exclusions under these Terms or applicable law, we will not be liable to you for any loss or damage you suffer in connection with the Services:
if the Third Party or another party is responsible for such loss or damage;
if it was due to abnormal or unforeseeable circumstances beyond our control, which would have been unavoidable despite us using reasonable efforts to prevent the same or that is not an obvious consequence of our breach or negligence or not contemplated by you and us at the time we entered into these Terms;
if we refuse you access to the Services or any other product or service we provide;
if you used, attempted to use, or intended to use, the Services in breach of these Terms or to conduct illegal or prohibited activity;
if you negligently, or intentionally, failed to take all reasonable precautions to keep safe, and prevent fraudulent use of, your mobile device and security information;
if you acted fraudulently or contrary to applicable law; or
if you were aware of the risk of the Services being accessed without authority but failed to inform us promptly.
8 . TERMINATION
We can restrict or suspend our provision of Services to you without liability at any time.
You have the right to terminate these Terms at any time without notice by withdrawing your agreement to receive the Services, also via the Third Party.
We have the right to terminate these Terms, with immediate effect if:
you have given us any false information;
you are using the Services illegally or fraudulently;
you do not meet the eligibility criteria for our Services;
you have seriously and/or persistently breached these Terms;
the Third Party no longer authorizes us to offer our Services to you; or
the Third Party no longer has the right to offer our Services to you.
We have the right to terminate these Terms for any reason without prior written notice.
Upon termination of these Terms for any reason:
we will no longer provide any Services;
all rights granted to you under these Terms will cease; and
you must immediately cease all activities under these Terms, including your use of any Services.
Any of these Terms which expressly or by implication are intended to come into or continue in force on or after termination will remain in full force and effect.
Termination will not affect any rights, remedies, obligations or liabilities that have accrued up to the date of termination.
9 . ALTRE DISPOSIZIONI
We may use sub-contractors to deliver the Services.
The provisions of these Terms are personal to you, and you cannot assign or transfer any of your rights or obligations under them. We can assign or transfer our respective rights and/or obligations under these Terms.
If any provision of these Terms is or becomes illegal, invalid or unenforceable that will not affect the legality, validity or enforceability of any other provision of these Terms.
Nothing in these Terms affects the liabilities, rights and obligations of you and the Third Party under the applicable terms between you and the Third Party.

If you act as or on behalf of a sole trader, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from the use of our services will be at the registered office of the Company (currently located in Berlin, Germany). The same applies if you do not have a general place of jurisdiction in Germany or if his or her place of residence or habitual abode is unknown at the time the action is filed. These Terms shall be governed by and construed in accordance with the laws of Germany. In accordance with Regulation (EU) No. 524/2013 of the European Parliament and of the Council of 21 May 2013, the European Commission provides a platform for online dispute resolution (OS) for consumers.
